As usual, our Illegitimate SCOTUS is doing the bidding of Corporate America as they weaken the EPA’s ability to enforce the Clean Water Act:
The Supreme Court on Thursday cut back the power of the Environmental Protection Agency to regulate the nation’s wetlands and waterways, another setback for the agency’s authority to combat pollution.
At issue was the reach of the landmark, 51-year-old Clean Water Act and how courts should determine what count as “waters of the United States” under protection of the law. Nearly two decades ago, the court ruled that wetlands are protected by the Clean Water Act if they have a “significant nexus” to regulated waters. Property rights and business groups wanted to narrow regulations to wetlands and other areas directly connected to “navigable waters” such as rivers and lakes.
OK, so which one got to do it? You know that they were arm wresting for the honor.
But Justice Samuel A. Alito, writing for the majority in the 5 to 4 opinion, said the EPA’s interpretation of its powers went too far.
“We hold that the CWA extends to only those wetlands with a continuous surface connection to bodies that are ‘waters of the United States’ in their own right, so that they are ‘indistinguishable’ from those waters,” Alito wrote, quoting from past court opinions.
But don’t worry for the SCOTUS, I’m sure Harlan Crow will give the Republicans on the court a lifetime supply of potable water.
Defund the illegitimate SCOTUS. Let’s see how much business they can do with no money to run the court.

I gave $25 to Kucinich back when he was in Congress, the only donation to a politician I remember. I vote for the Democrats, but that’s all – there are plenty of other groups out there can use money.

I am a real stickler for water quality protection and preventing it being wasted. Grew up in drought conscious CA and AZ. Currently in an imbroglio over a guy in our little community pressure washing asphalt. Watched the waste water running down the gutter a block or so downhill and into a drain that empties directly into our seasonal creek and to our gorgeous local lake. (I live in the PNW-upper left hand corner.) In addition we just bought a property covered in natural forest and going through the wetlands designations on it. The county is strict! The little pockets of mud here and there are protected and mitigated. But…left coast, ya know? Wondering how this change in the CWA will affect it.
