Note I wrote my comment on the previous post before reading this. Garland dropping any prosecution to ‘appear impartial’ will simply be catastrophic.

I totally agree with your memo. Am I wrong to think he will never be charged as a candidate? It is almost too late. We must charge him now.

He can be charged as a candidate, but it will feed the Deep State meme and get the Red Hats undies in a bunch and probably some more insurrection activities…
There’s no reason to not charge him other than political fear.
