Report: We Got Options To Get Around Slow-Walking AG

Hold me closer, Tiny Hands-er.

The January 6 Insurrection Committee unanimously voted to pursue criminal contempt of Congress charges against area podcaster Steve Bannon. Yay!

Sayeth Darth’s Little Deferment, Liz:

“Based on the committee’s investigation, it appears that Mr. Bannon had substantial advance knowledge of the plans for January 6th and likely had an important role in formulating those plans. Mr. Bannon was in the war room at the Willard on January 6th. He also appears to have detailed knowledge regarding the president’s efforts to sell millions of Americans the fraud that the election was stolen.”

“They suggest that President Trump was personally involved in the planning and execution of January 6th. And we will get to the bottom of that.”

The full House is expected to vote on the matter tomorrow (pro tip: expect a party-line vote) and then it will be up to self-proclaimed protector of institutions and not democracy AG Merrick Garland and the Department of Justice to decide what to do, and so we are not encouraged. We predict Garland’s DOJ will say that the executive privilege lawsuit filed by Donald Trump must be resolved before they will act, and we know that we are totally eff’ed in the dark if we have to depend on him.

Anyway, University of Chicago law professor Aziz Huq sez that he sees two possible options to get around slow-moving DOJ (paraphrasing):

  • The Committee could ask the President to decide what is and what is not classified (which presidents have the authority to do), and turn over the documentation the committee seeks.
  • President Handsome Joe Biden can ask his aides to read the documents that the Committee wants to know about, and then answer whatever questions are asked.

I don’t know if President Handsome is willing to play hardball, but I can dream, right?

    On another forum (TPM) a commenter pointed out that the referral with go to the US Attorney for D.C. first. So maybe Garland won’t get involved the way the prior AG did to cover Rudy’s ass in the S.D.N.Y. (and in other venues for other criminals).
