A few realities a day after the Supreme Court abortion decision:

1) Several states are already weighing copycat laws. As our Alice Miranda Ollstein and Josh Gerstein report, top officials in Arkansas, South Dakota and Florida announced they’re looking to replicate Texas’ citizen enforcement scheme for their own abortion laws, while lawyers also say blue states may try to adopt a similar structure for getting around the courts on things like guns and Covid-19 precautions. Courts could, however, strike down Texas’ law long before those state legislatures have a chance to attempt those legal gambits.

2) There’s virtually nothing Democrats can do. President JOE BIDEN and Speaker NANCY PELOSI can say they’ll try, and liberals can make demands, but the votes simply aren’t there in the Senate to pre-empt the Supreme Court’s upcoming ruling on whether to overturn Roe v. Wade.

3) Some conservatives who oppose abortion rights are arguing the Texas law is a terrible vehicle to advance the cause. From its six-week ban on abortions to the “bounty hunter” provision and no exceptions for rape or incest, it means they’re swimming against popular opinion, even among those who are sympathetic to curbing abortions. House to vote on bill guaranteeing abortion access in response to Texas law

SpeakerNancy Pelosi (D-Calif.) said Thursday that the House will vote on legislation to guarantee access to abortion upon its return to Washington later this month after the Supreme Court refused to block a restrictive Texas law that bans most abortions.

This is something that Congress should/could have done since the 1973 decision. In fact, they should/could codify into law all the social protection rulings. All of them are up for grabs from the radical and illegitimate John Roberts’ SCOTUS.

But I digest...

Pelosi said that after the House returns to session on Sept. 20, the chamber will vote on a bill from Rep.Judy Chu (D-Calif.) to statutorily protect a person’s ability to seek an abortion and for health care providers to provide abortion services. She called the Texas law “a flagrantly unconstitutional assault on women’s rights and health” and a “catastrophe.” 

So, what’s going on in the Senate?

Joe Manchin’s demands must be met!

Across the Capitol, the Senate companion bill to Chu’s legislation has the support of 48 Democrats. Two Democrats, Sen. Joe Manchin (W.Va.) and Bob Casey (Pa.) have not signed on as co-sponsors.

Oh, Christ, this asshole, AGAIN?

If you search Joe Manchin’s Senate web page for “pro-life” you will get back tons of hits with a version of “I am pro-life and proud of it.,” so Pelosi’s attempt is an effort that will run head-on into our usual suspect.

I’m not saying give up or run away. Manchin also says he has the usual slippery-slope exceptions of rape, incest, life of the woman. The Texas law does NOT exclude those conditions in their abortion ban, so he could (maybe?) find a way to be talked into it.

One other reason to have a bit of hope:

Democrats think the issue will especially help them with suburban voters, who hold the key to the House majority. Apparently Fox agrees and doesn’t want to cover it.

    Abortion is an issue that the GQP has mined for decades. It brings in money and True Believers without having to do anything about it. Here’s hoping the Texassss legislation bites the GQP on their rotund asses.

    I am thinking that a blue state should enact a law that uses the same mechanisms that this one does to get around the constitution only for guns. The Supremes will be quick to shoot it and those mechanisms down to protect the precious second. And that will set the precedent to shoot down the Texas bill.

      Good call.
      Also, agreed with Tengrain; repro privacy rights should have been written into federal law long ago.
      Also universal US health insurance and care, so people can stay well, and people’s privacy can be more assuredly protected from those who intrude and would deny a patient their rights to their own medical decisions. whew. Sorry that went long.

    Howdy y’all!

    Just like we should all low continuously and loudly whenever Devin Nunes appears in public until he leaves, we should all just repeat loudly and continuously to each other, “Oh, Christ, THAT asshole, AGAIN,” whenever Manchin is seen in public. Nothing but shunning and shaming will deter these people because they certainly don’t feel any shame themselves.
