Mitch McConnell Goes Nyuck-u-Lar

Tiger Beat on the Potomac (thanks Charlie!) morning email thingie tells us that amply be-chinned Mitch McConnell (R- Moscow) has completed his life work (bizarre emphasis their):

NO VACANCY LEFT BEHIND — The Senate GOP reached a new milestone under Trump: confirming 200 federal judges. Marianne with the latest: “In a 52-48 vote, the Senate approved Cory Wilson to the powerful U.S. Court of Appeals for the Fifth Circuit. Sen. Susan Collins (R-Maine) was the sole Republican to vote against his nomination, along with all Democrats. Prior to his confirmation, McConnell described Wilson as an ‘outstanding choice’ with impeccable legal credentials.

“The Kentucky Republican also highlighted that Wilson’s confirmation means that there will no longer be any circuit court vacancies for Trump and the GOP to fill. ‘There will not be a single court vacancy anywhere in the nation for the first time in at least 40 years,’ McConnell said. ‘Our work with the administration to renew our federal courts is not a partisan or political victory. That’s enough to make a maggot puke.

So we’ve lost the DOJ, and now the judiciary is stacked for a generation or longer. We must have a Nuremberg-style trial at the end of the dystopian nightmare, one in which Mitch McConnell gets a starring role and hopefully a last cigarette.

    We simply increase the number of judicial positions available and approve judges to restore balance.

    McConnell’s statement that “Our work with the administration to renew our federal courts is not a partisan or political victory. It’s a victory for the rule of law and for the Constitution itself” is right out of 1984. It’s nauseating. Not even he believes that.

    Judges that are installed can always be recalled. It’s a long, drawn-out process, usually, but they CAN be recalled. Basically, what it comes down to is very similar to the prezinential impeachment process: The House moves, and then votes to impeach, followed by a Trial in the Senate, which removes the Judge if he’s found guilty. Which we know ain’t gonna happen under this regime.

    Alternatives do not abound, yet they can be found: “The Constitution authorizes the impeachment of federal judges, but it nowhere says that they can be removed only through impeachment. Nor do the Constitution’s relevant provisions easily lend themselves to any such reading.” Uh-oh. From the same article: “Article III conditions a judge’s tenure on continued “good Behaviour”; the clear implication is that misbehavior can terminate a judge’s stay in office.” You don’t say…

    Those who think judges may only be removed by impeachment might suppose that history reveals that “good Behaviour” was a term of art that meant something like “tenure for life defeasible only by impeachment.” History actually proves that good behavior was independent of impeachment.

    I don’t know about the rest of you, but this gives me hope that once that Orange Monstrosity is outta the WH, and we gain sufficient Senate seats, we can undo and then redo everything these Repukes have done.
