House Ways and Means Chairman Richard Neal is filing a lawsuit against the U.S. Treasury Department in an effort to compel the Internal Revenue Service to turn over President Trump’s tax returns.

Why it matters: Treasury Secretary Steven Mnuchin has denied multiple requests for Trump’s tax returns, including a subpoena from the House Ways and Means Committee in May — arguing that the demands “lack a legitimate legislative purpose.” The result of Mnuchin’s defiance is likely to be a protracted court battle.

What they’re saying:

  • The lawsuit argues that a section of the IRS code requires “in mandatory terms that Treasury ‘shall furnish'” the House Ways and Means Committee with “any” tax return information that is requested, and that Trump has denied the request for what the committee believes is the first time ever.
  • In response to Treasury’s argument that the request lacks a “legitimate legislative purpose,” the lawsuit claims that nothing in the relevant IRS code requires an explanation, but adds that nonetheless:

The Committee’s need for the materials requested here is evident. The Committee is investigating the IRS’s administration of various tax laws and policies relating to Presidential tax returns and tax law compliance by President Trump, including whether the IRS’s self-imposed policy of annually auditing the returns of sitting Presidents is working properly, even though it has not been updated in decades.”

    I don’t understand why Steve Missing Vowel has not already been arrested and imprisoned for refusing a Congressional sub poena.

      Because it’s a civil matter, and not a criminal one. There ARE precedents for imprisoning and fining those who ignore Congressional subpoenas, but the process is convoluted, and requires the FBI to effect the arrest, and the guy who’s in charge of the Fibbies is none other than Bill “Low” Barr, so we don’t have that going for us anytime soon.

  5. Dems play hardball? In which universe is this happening? More like wiffle ball where the pitcher instead keeps throwing to the second baseman. Don’t even start me on the July 4 Self Coronation of Trump.
