    I’m confused.
    Are we saying that it doesn’t matter where the money came from?
    I’m reading that if the money was not campaign funds, but personal out-of-pocket money, it would not be a felony violation unless the prosecution could prove that the motive for the expenditure was to “influence the outcome of an election”.

    Well to any sentient being, obviously it was, but proving that was the motive, rather than, say, “protecting my family” or some bullshit, would not be easy without some heavy corroborating evidence, like maybe Cohen or someone having him on tape saying it.

    He’s for sure guilty of signing reporting forms which didn’t include those expenditures when I think the law requires them to be reported, but that’s a different infraction and just a wrist slapper that more than a few candidates have fallen afoul of over the years. Usually a fine and an apology for the “mistake” makes it all go away.

    Certainly this salvo has shredded a couple of topsails and damaged a bit of the rigging, but it’s gonna take more than this, a lot more than this, to hole the SS Trump below the waterline.

      He’s guilty of this and so much more; NYC will nail him/family for his illegal behavior vis a vis his charitable foundation; Mueller isn’t anywhere near done yet; lil’ Donnie Jr is toast; others will turn and the hits will keep on coming.

      It will be totality of his crap, along with a rising Democratic tide in Congress, that will do him in.

        Tough to have patience when things keep getting worse and more dangerous for us average people. It’s nearly the only strategy we have available, though – you know, outside of patiently reminding our representatives that some of us are watching, patiently waiting to vote…

      Yeah, there are recordings and apparently they are damning as to motive. Also, he was the GOP candidate and right before the election so a lot of motivation.

    His narcissism and stupidity are so overwhelming that he can’t imagine that something like “the law” would apply to him. After all, he’s flouted it his entire life and gotten away with it, mostly. He thinks he can create his own reality and just bullshit his way through it. In his universe, the law, whatever that is, simply doesn’t apply to people like him, and poor Paul Manafort.

    The MSM is contributing to the confusion here, but it shouldn’t help Comrade Stupid. The facts around the payoffs to Stormy Daniels and Karen McDougal are being twisted and conflated often to minimize the degree of criminality involved. The one Cohen tape we have all heard involves the payoff to The National Enquirer to keep McDougal silent. In that tape, it is established that Trump was personally involved in the plan, there is a nexus to the election, that a shell company is being used to hide a papertrail and the amounts involved exceed legal limits. From the Stormy Daniels case, we know that the same shell company was used, that Cohen fronted the payoff and was subsequently reimbursed through a retainer agreement with funds coming from the Trump Organization months afterwards, that the reimbursements far exceeded what was ostensibly needed for Daniels and McDougal and provided Cohen a handsome payoff for services rendered. None of any of this was reported on campaign finance filings which is more than the technical violation (accident/oversight) that typically involves, since using a shell company, a tabloid publisher and a political fixer goes to the intent to hide the activity and defraud the government.
